Unmarried, cohabiting partners are at risk when their home-owning partner dies. 

That’s because they have no automatic “Right To Reside.” 

It comes as a great shock to many who find themselves in this position. 

And it happens far more than you realise. 

If there’s no specific provision in the deceased’s will (or if there is no will), their partner is at risk.

Usually, the risk comes from the children of the deceased. 

They want to sell the property and realise their inheritance. 

If an earlier will has named the children as beneficiaries, the surviving partner may be in trouble. 

They will be reliant on the children’s goodwill, and that’s not something that can be relied on. 

So, if you want to protect your partner while ensuring that your children eventually inherit, you need to do at least one of the following things.

  • Make a will if you haven’t already 
  • Update an old will 
  • Put some planning in place
